TERMS & CONDITIONS
Definitions
Agreement: The rental agreement together with the terms and conditions, the pre-check form and any other documentation required by us to be signed by you in connection with your rental of the vehicle.
The Lessor / We / us / our / the owner: Coastal Cruisers LLC
The Lessee/the Renter/You/ the Client/the customer: The person, company, firm or organization signing the Rental Agreement, together with any authorized driver stated on the Rental Agreement.
Rental Period: The period in which the Vehicle is in your control and possession.
Reservation: The period in which the Lessee has reserved the services of Coastal Cruisers LLC
Event: also referred to as the Rental Period will be the date and time in which the Lessee has rented the services of Coastal Cruisers LLC
Vehicle: The vehicle described in the Rental Agreement, including any documentation, wheels, tires, tools, accessories and any other related equipment, as well as any vehicle with which it may be substituted in our discretion.
Coastal Cruisers LLC reserves the right to refuse to hire any of the vehicles at its own discretion.
Terms & Conditions of the Rental Agreement between You and Coastal Cruisers LLC.
The customer declares that they meet the requirements and have legal capacity to contract the service provided by Coastal Cruisers LLC in accordance with the present Terms & Conditions, which the customer declares to understand and accept. Coastal Cruisers LLC is not responsible for the accuracy of the data provided by its customers.
Booking and Rental Agreement Terms & Conditions
On completion of the booking form you acknowledge and accept without question the Terms & Conditions, assuming an obligation to Coastal Cruisers LLC in accordance with the provisions of this document. By signing the rental agreement, you acknowledge and declare to understand the conditions of the agreement, depending on the rented vehicle, and that you are bound by the provisions of the agreement and this document.
Reservation process
Customers can make a reservation through Coastal Cruisers´ website (www.coastalcruisersal.com) via a) the booking form, which will not have any legal value until written confirmation from Coastal Cruisers has been received; b) sending an e-mail to coastalcruisersal@gmail.com or; c) by telephone. Customers have the option of making payment by a)bringing payment for the rental/deposit to our place of business, b) mail the payment to our place of business, or c)pay by credit card. If a customer chooses to send payment via the mail we request that the Event be no less than fourteen (14) days in advance. Coastal Cruisers may request further information in order to speed up the booking process.
Reservations are not confirmed until a contract between the Lessee and the Lessor has been signed and put on file with Coastal Cruisers LLC and Coastal Cruisers LLC has received the Non-Refundable First Payment. Once Coastal Cruisers LLC has received received the Non-Refundable First Payment and a signed contract from the Client a reservation confirmation will be sent to the client outlining the dates and details of their reservation. Such reservation confirmation will be binding to the client.
During the reservation process, it is possible to hire additional services not included in the price of the rental as per Annex I of the present document. The customer will be designated as holder of the agreement otherwise it shall be notified to Coastal Cruisers. Coastal Cruisers is not responsible for any direct or indirect technical issues derived from the reservation process, which do not allow hiring the service. The customer is responsible for checking the reservation process and shall inform Coastal Cruisers of any incidents that may have occurred during the reservation process in order to help solve them without prejudice to the parties.
Non-Refundable First Payment: A Non-Refundable First Payment of $100.00 will need to be made in order to reserve a vehicle. Services must be paid in FULL fourteen(14) days prior to date of services. The First Payment is Non-Refundable and will go towards the Total Balance owed. If a client Cancels or Does Not Show the Non-Refundable First Payment will be retained by the company to cover expenses incurred.
Payment of the Non-Refundable First Payment: The First Payment secures the reservation. The First Payment can be made by check, cash, or any major credit card. If payment is made via mail we request that payment is made by check, money order, or cashier’s check.
Changes or cancellation of bookings
Changes or cancellations of bookings must be made in writing. Coastal Cruisers LLC's company email is coastalcruisersal@gmail.com (changes or cancellations will not be effective until receipt of written confirmation from Coastal Cruisers). Coastal Cruisers LLC's mailing address is 16866 Engel Lane Foley, AL 36535.
When reserving via partner websites or an Agent, the cancellation policy and conditions are subject to that respective partner or Agent. During the rental period, modification requests on the rental agreement can be made following the same procedure as for cancellations.
The First Payment is Non-Refundable. If cancellations or changes are made within fourteen (14) days of the Reserved Date any monies (including but not limited to the First Payment) exchanged between the Client and Coastal Cruisers will not be refunded.
In the event that the Client must reschedule or cancel their event, Coastal Cruisers will issue a Company Voucher that is good for up to two years after the Client's initial rental period. The Company Voucher will allow for the Client to reschedule the services they have reserved with Coastal Cruisers for services equal to the services the Client had previously purchased.
Rates & Charges
Customers will pay for: a) the rate for the agreed rental period and of the chosen vehicle category at the time of entering the contract and specified on page 1 of the rental agreement; b) a travel fee or trailer fee for delivery or pick up of the vehicle if applicable c) a Fuel Charge of $3.00 per mile from our headquarters in Foley, Alabama to the furthest distance on the Client's itinerary.
Our responsibilities
All our cars are maintained to the highest standard. We assure you that the vehicle is roadworthy and suitable for renting at the start of the rental period. We will not hire a vehicle with known safety or reliability faults and therefore Coastal Cruisers LLC does not in any way guarantee that the vehicle being chauffeured for the event will be the specific one the Client has chosen. Coastal Cruisers will make the upmost efforts in trying to have the vehicle the Client has reserved be the same vehicle chauffeured during their event. However, Coastal Cruisers does reserve the right to substitute the vehicle for an equally classified vehicle (i.e. classic or antique). We are not responsible if someone is injured or dies as a result of negligence, act or failure to act. We are not responsible for any consequential loss in any circumstances arising from breakdown or non-availability.
Breakdown/Repairs
Should the Vehicle break down or should you experience any mechanical difficulties, please report immediately to us. No repairs to the vehicle should be made without prior approval from Coastal Cruisers. It is in the nature of classic cars that they may be less reliable than modern cars. For this reason, we offer a generous service in the event of breakdown. Our Vehicles are covered by 24-hour breakdown assistance and in the event that quick repairs cannot be made, we reserve the right to offer a substitute vehicle (upon availability). In the event of not being able to offer another model, Coastal Cruisers will issue a Company Voucher that is good for up to two years after the event.
Classic Cars Particularities
Being chauffeured in a classic car is fun and a memorable experience, however, it may have some particularities. We inform you that none of these particularities may be cause for cancellation of the contract, excuse to take damage or breakage caused by improper or negligent use of the vehicle or any of its elements or damages because of the special features below, typical of classic cars:
Discomfort for the structure, size or cushioning of the seat or the driving position.
Difficulties in operating any devices, the steering wheel, pedals and gear stick.
Lack of regulation of components that prevent reaching optimal position of the driver or passengers.
Louder noise level than in modern cars.
Greater difficulty of use, lower efficiency or inaccurate or special tact of certain mechanical elements such as door locks, engine, steering, brakes or suspension.
Inferior passive and active safety measures when compared with those of a modern car, but compliant with the legal requirements for the period of manufacture.
Vintage accessories, outdated security elements or elements which would not pass the current homologation standards but compliant with the legal requirements for the period, target market or date of manufacture of the car.
Combustion or exhaust odors while driving or parking, light oil leaks, exposure to grease or dirt.
Conditions outside the Control of Coastal Cruisers
If it is impracticable for Coastal Cruisers to perform any of its obligations as the result of events or conditions beyond its control such as but not limited to war, unrest, air plane hi-jacking, terrorist attacks, all natural catastrophes, power cuts, strikes, lock outs, pandemics, famine and similar events Coastal Cruisers will issue a Company Voucher to the Client that is good for up to two years after the event. The Company Voucher will be equal to the services that the Client had previously reserved with Coastal Cruisers.
Conditions outside the Control of the Customer
If it is impracticable for you to perform any of your obligations as a result of general events or conditions beyond your control, Coastal Cruisers will provide the Client with a Company Voucher that is good for up to two years after the event and equal to the services that the Client previously reserved with Coastal Cruisers. This includes war, unrest, aero plane hi-jacking, terrorist attacks, all natural catastrophes, power cuts, strikes, lock outs, pandemics, famine and similar events. You should note, however, that events and conditions that are beyond your control but that are not general in nature, including, without limitation, the condition of your health and the health of those travelling with you, will not excuse the performance of your obligations under a booking; you should consider travel insurance or similar arrangements to protect you against unforeseen events and conditions that are specific to you and those travelling with you.

If the client Cancels or Does Not Show within fourteen (14) days of their event the Non-Refundable First Payment as well as any and all other monies exchanged will be retained by the company for expenses incurred.
Confidentiality Clause
Coastal Cruisers may request to customers and drivers’ personal data through its website www.coastalcruisersal.com. Any supplied data will be incorporated into the automated file of personal data, property of Coastal Cruisers, which will be processed in order to provide the services requested by the customer. Customers authorize Coastal Cruisers to include the data provided in the files and their treatment for management and recording purposes of the transactions between both parties. The customer, the main driver and the additional drivers ensure that the information provided is accurate and they authorize Coastal Cruisers to: include personal data in Coastal Cruisers’ database; the automated/manual treatment of the data for management and recording purposes of the transactions between both parties. Customers also authorize the use of personal data to send them any of our promotions, products or services which may be available from time to time, either by Coastal Cruisers or third parties. Personal data sent by the client is stored in a database owned by Coastal Cruisers, compliant with the required technical and security measures to ensure the confidentiality and integrity of the data provided, in accordance with the provisions of the 2016 Code of Alabama Title 41- State Government, Chapter 10-Authorities, Article 12 Alabama Supercomputer Authority Section 41-10-399 as well as other regulations in force. Coastal Cruisers will only use your bank details for the collection of any fees related to the rental agreement. We will not register your bank details into any database, whether it is owned by Coastal Cruisers or by a third party, unless the price or additional costs are unpaid, or when any of the present Terms & Conditions is broken by the customer. In such case, Coastal Cruisers may include your data in a defaulters’ list, whether it is owned by Coastal Cruisers or by a third party. Should the client or drivers wish to access, modify, oppose or cancel their data, customers can send a letter to Coastal Cruisers, or 16866 Engel Lane Foley, Alabama 36535 or by calling to the telephone number published on our website www.coastalcruisersal.com or by sending e-mail to coastalcruisersal.com.
Intellectual & Industrial Property
All text and images on the website www.coastalcruisersal.com, including trademarks, trade names, designs or models, drawings, texts, photographs, graphics, logos, icons, software or any other signs or products subject to industrial and commercial use are owned by Coastal Cruisers or their respective owners, who have authorized their inclusion on the website and are protected by law. Any modification, reproduction, copying, distribution, sale, resale and other forms of exploitation for commercial purposes without authorization of Coastal Cruisers is prohibited.
Entire Agreement
Should any terms of provisions of these terms and conditions be found to be unlawful, void or unenforceable, then that provision, shall to the extent required, be deleted from the Agreement and made ineffective insofar as possible, without the need for modification of the rest of the Agreement and shall not in any way affect any other circumstances of or the validity or enforcement of these Terms and Conditions. We reserve the right to vary the rates, terms and conditions of hire, and to refuse to rent a vehicle to any person without explanation or notification. These Terms & Conditions supersede all previous versions, and any or all prior written or oral communications between the parties and incorporate the whole agreement. In the event of any inconsistency between these terms and conditions and any other literature, such as our website or brochure, the provisions of these terms and conditions will prevail.
Governing Law
The present Terms & Conditions and the Rental Agreement shall be governed by United States law. In case of any actions or claims or disputes that may arise, the parties submit to the jurisdiction of the Courts of the city of Foley, Alabama. “Coastal Cruisers” is a registered trademark. Anyone found operating under this name without written permission from
Coastal Cruisers LLC with the relevant director’s signature, will be prosecuted for Copyright Infringement.
